Terms of service.
What we do, how the trial and billing work, what stays yours, and the limits. Plain English, because an agreement you cannot read is not much of an agreement.
These terms are the agreement between you and Dezenyo, a studio that designs and runs online stores for the people who make things. They cover using this website and signing up for our service, wherever in the world you are. We have kept them in plain language. If anything here is unclear, email us and a real person will answer.
The basics
By using dezenyo.com, or by starting a free concept, a call, a trial, or a subscription with us, you agree to these terms. If you are agreeing on behalf of a business, you confirm you are allowed to do that. If you do not agree with something here, the simplest thing is not to use the service, but we would rather you email us so we can talk it through.
What we do
The service
We design your online store, build it, and then run it for you for a monthly fee. The exact work included depends on the plan you choose. The current plans, what each one includes, and the price are set out on our pricing page, which forms part of these terms.
The free concept
Before you pay anything, we can build you a free concept of your store. It is genuinely free and there is no obligation to continue. The concept is a sample of our work and stays ours until you sign up, at which point it becomes the starting point for your store.
You and your account
Our service is for people running, or about to run, a business. When you sign up you agree to give us accurate information and to keep it up to date. You are responsible for anything done through your account and for keeping your login details safe. Tell us straight away if you think someone else has got into your account.
Plans, the free trial, and billing
Plans and price
You choose a plan when you sign up. The price and the currency are whatever is shown on our pricing page and at the checkout at the time you subscribe. We may change our plans and prices in the future, but a change will never affect a period you have already paid for, and we will tell you before your next renewal.
The 30-day trial
Most plans start with a 30-day free trial. The trial is your risk-free window to see the work and decide. You are not charged until the trial ends, and you can cancel during the trial and pay nothing.
How billing works
After the trial, the subscription runs monthly and is billed in advance through our billing partner, Whop, under their terms. Separately, when your store takes payments from your own customers, that money runs through your own payment account (for example Stripe) under that provider's terms. This website never collects or stores your customers' card details.
Taxes
Prices may not include taxes that apply where you are. You are responsible for any such taxes unless we tell you otherwise.
Cancelling, and what is yours to keep
You can cancel at any time. Your cancellation takes effect at the end of the period you have already paid for, and you are not billed again after that. There is no cancellation fee.
Because the trial is there for you to decide risk-free, paid months are not refundable once they have started. Cancelling always stops every future charge.
Your brand, your content, your products, and your domain name are yours. If you decide to leave, we will help you take your content and your domain with you, so your store does not just disappear.
Who owns what
You keep all rights to your brand, your logo, your product images, your words, and anything else you give us. By giving them to us, you let us use them for the single purpose of building and running your store.
The store we build for you is yours to keep using while you are a subscriber, and we will help you take it with you if you leave. The systems, templates, components, and code we reuse across the stores we build stay ours. With your permission, we may show your store in our portfolio and case studies.
Your side of the deal
For us to do our job, you agree to:
- give us the assets, access, and answers we need, within a reasonable time;
- only sell lawful products, and nothing that is prohibited, counterfeit, or that infringes someone else's rights;
- follow the rules of any service your store relies on, including your payment provider and our billing partner;
- handle your own customers' data lawfully; and
- not misuse the site or the service, for example by trying to break, copy, or resell the underlying system.
Other companies in the mix
We build on a small set of trusted providers, and each has its own terms that apply to you: Whop for subscription billing, your payment provider (such as Stripe) for taking customer payments, Cloudflare for hosting, Google for analytics, Calendly if you book a call, and a domain registrar for your domain. We are careful about who we use, but we are not responsible for their own outages or decisions. If one of them causes a problem, we will do our best to help you sort it out.
What we promise, and the limits
We put real care into every store and we run it like it is our own. What we cannot do is promise a specific result, such as a particular number of sales, a search ranking, or uninterrupted uptime, because those depend on many things outside our control. To the extent the law allows, the service is provided as is.
Nothing in these terms removes any right you have that cannot be removed under the law that applies to you. Beyond those rights, if something goes wrong, the most we are liable to you for is the total amount you paid us in the three months before the problem, and we are not liable for indirect or knock-on losses.
You agree to cover us for claims that come from your own products, your content, or your use of the store, since those are yours.
Changes, ending it, the law, and reaching us
Changes to these terms
We may update these terms as the service grows. If we make a significant change, we will let you know and update the date at the top. Carrying on using the service after that means you accept the new version.
Ending the agreement
You can leave at any time, as set out above. We may suspend or close an account if these terms are seriously or repeatedly broken, or if we are required to by law. Where it is fair to, we will warn you first and give you a chance to put it right.
The law that applies
These terms are governed by the laws of the Philippines, where Dezenyo is based, and its courts have jurisdiction over any dispute. This does not take away any consumer protection you have under the law where you live.
